Foreign Student Avoids Prosecution for Digital Sex Crime: D-2 Visa Maintained
A Japanese student on a D-2 visa in Suwon was investigated for digital sex crime (sending obscene images via messaging apps, known as “통매음” in Korea) after sending a photo of his body during an online chat.
Although he later explained it was meant as a joke, the recipient filed a complaint, and he faced the risk of criminal prosecution — and possible deportation.
Dongju Law Firm’s defense team acted quickly. They guided the client through his police statement, emphasized his status as a first-time offender, and carefully negotiated with the victim.
Through sincere apologies, written reflection, and settlement efforts, the victim ultimately submitted a statement of non-punishment.
The firm further presented evidence of the student’s good academic record, future career plans in Korea, and completion of a prevention program.
✅ The result? The case was closed with a non-prosecution (기소유예) decision, and immigration authorities allowed him to maintain his D-2 student visa.
