Conditional Non-Indictment in Minor Telegram Sexual Exploitation Case (F-3 Visa Family)

A Vietnamese national’s child, residing in Korea under an F-3 dependent visa, became the subject of a criminal investigation after being identified as a participant in a Telegram group chat where deepfake sexual content involving minors was shared.

The juvenile joined the chat out of curiosity after being invited by peers. Although the group contained digitally manipulated sexual images (deepfake content), the client did not create, distribute, or upload any materials. The involvement was limited to viewing content within the group.

Despite this, all group participants were investigated under the Act on the Protection of Children and Juveniles from Sexual Abuse, placing the juvenile at risk of criminal punishment and potential immigration consequences for the family. Recognizing the seriousness of the matter, the parents sought immediate legal assistance from Dongju Law Firm.

Key defense strategy:

• Clarifying the scope of involvement
  Demonstrating that the juvenile neither produced nor distributed sexual exploitation material, and that participation was limited to passive viewing.

• Emphasizing juvenile status and first-time offense
  Highlighting the client’s age, lack of criminal history, and limited understanding of the legal implications of online conduct.

• Demonstrating absence of criminal intent
  Arguing that the conduct stemmed from curiosity rather than sexual exploitation intent, with no profit, coercion, or planning involved.

• Presenting strong parental supervision and rehabilitation measures
  Submitting guardians’ statements, written apologies, and commitments to ongoing supervision, education, and prevention of reoccurrence.

✅ The result?

The prosecution granted a conditional non-indictment (educational diversion), requiring the completion of a special educational program instead of criminal prosecution.
As a result, the juvenile avoided a criminal record, and no negative impact occurred on visa status or family residence in Korea, allowing the child to continue school and daily life without disruption.
